SECOND AMENDED NOTICE OF CONTINUED PUBLIC MEDIATION DISPUTE RESOLUTION PROCEEDING
Zoning Ordinance PDR-23-19 (Z)(P) – 145816 & 15820 County Road 675, Case No. DR-24-02

Re: Notice of Request for Relief and Dispute Resolution under the Florida Land Use and Environmental Dispute Resolution Act pursuant to Section 70.51, Florida Statutes, regarding approximately 53.08 acres of real property generally located on the north side of CR 675, approximately 1.14 miles west of the intersection with North Rye Road, Parrish (Manatee County), Florida.

The Request for Relief was filed on August 13, 2024, by Attorney Scott Rudacille, Blalock Walters, P.A., representing Oak Development Group, LLC, a Florida Limited Liability Company, and Brett and Brenda Johnson and Robert and Gail Stinson, (collectively the “Petitioners”). The Request for Relief states that Brett and Brenda Johnson are the fee simple owners of one of the properties that was subject of the Application, and that Robert and Gail Stinson are the fee simple owners of the second property the subject of the Application and Oak Development Group, LLC, is the contract purchaser of the Property for which the Petitioners filed Application PDR-23-19(Z)(P), requesting a rezone and approval of a proposed preliminary site plan for 108 single-family detached dwelling units, which were denied by the Board of County Commissioners on June 20, 2024 by the adoption of Resolution No. R-24-121. The subject real properties are zoned A-1 (Agriculture Suburban) and are designated Urban Fringe – 3 (UF-3) on the Future Land Use Map of the Manatee County Comprehensive Plan and Land Development Code

The process for citizens to participate in the dispute resolution sessions is detailed in the Manatee County Code, Part II, Article III, Sections 2-25-30 through 2-25-44. The Requests to Participant previously filed for the February 3, 2025 mediation before the Special Magistrate, will be carried forward to the March 31, 2025 mediation.

The mediation and dispute resolution sessions being held before the Special Magistrate are pursuant to Section 70.51, Florida Statutes, and the process is detailed in the Manatee County Code, Part II, Article III, Sections 2-25-30 through 2-25-44. The hearing may be continued from time to time.

All interested parties may appear and be heard at the meeting with respect to the proposed Ordinances. According to Florida Statutes, Section 286.0105, any person desiring to appeal any decision made by the Board of County Commissioners with respect to any matter considered at said Public Hearing will need a record of the proceedings, and for such purposes, he may need to ensure that a verbatim record of the proceedings is made, which includes the testimony and evidence upon which the appeal is to be based.

Rules of procedure for Public Comment and Citizens’ Comments (including time limits) are governed by Resolution R-25-013, Restated Rules of Procedure (adopted 1/28/25).
