NOTICE OF PUBLIC HEARING

NOTICE OF LOCAL DEVELOPMENT AGREEMENT CHANGES IN UNINCORPORATED MANATEE COUNTY

 NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Manatee County will conduct a Public Hearing on July 25, 2023, at 9:00 a.m., and August 8, 2023, at 9:00 a.m., or as soon thereafter as same may be heard at the Manatee County Government Administration Building, 1st Floor Patricia M. Glass Chambers, 1112 Manatee Avenue West, Bradenton, Florida, to consider and act upon the following matters:

 LDA-06-06(R3) - Local Development Agreement for Eagle Pointe - PLN2303-0079

Approval of a Second Amended and Restated Local Development Agreement to provide general updates for code and statutory references, recognize the Proportionate Share Payment for the identified transportation improvements in lieu of construction, and updates to ensure that the agreement remains consistent with the Preliminary Site Plan approved pursuant to Manatee County Ordinance PDR-13-41(P)(R).

 As amended, the Eagle Pointe Preliminary Site Plan was approved on March 4, 2021, under PDR-13-41(P)(R) for a project consisting of approximately 674.0362-acres of real property located in Manatee County and generally located north of Moccasin Wallow Road, south of Buckeye Road, and east of I-75 and Carter Road, in north Manatee County bounded by. The site is in the Planned Development Residential (PDR) zoning district and it is approved for a maximum of 1,346 residential units within the Project Site, with a maximum residential gross density of 2.0 units per acre and with a maximum building height of 40 feet.

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN,  pursuant to Section 190.005 and Section 125.66, Florida Statutes, that the Manatee County Board of County Commissioners will hold a Public Hearing on July 25, 2023, at 9:00 a.m. (or as soon thereafter as may be heard), located on the first floor, Patricia M. Glass Chambers, of the Manatee County Administrative Center, 1112 Manatee Avenue West, Bradenton, Florida, to consider and act upon the following request made by Wilmington Land Company  (Petitioner):

ORDINANCE NO. 23-96

AN ORDINANCE OF MANATEE COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF FLORIDA REGARDING PUBLIC SERVICES; ESTABLISHING  WOODLAND PRESERVE COMMUNITY DEVELOPMENT DISTRICT; PROVIDING LEGISLATIVE FINDINGS; SPECIFYING AUTHORITY; SPECIFYING INTENT AND PURPOSE; CREATING SECTION 2-8-87 OF THE MANATEE COUNTY CODE OF ORDINANCES, ENTITLED "WOODLAND PRESERVE COMMUNITY DEVELOPMENT DISTRICT,"  ESTABLISHING THE WOODLAND PRESERVE COMMUNITY DEVELOPMENT DISTRICT PURSUANT TO CHAPTER 190, FLORIDA STATUTES,  DESCRIBING THE BOUNDARIES OF THE DISTRICT,  NAMING THE INITIAL MEMBERS OF THE BOARD OF SUPERVISORS FOR THE DISTRICT, AND  CONSENTING TO  CERTAIN SPECIAL POWERS BY THE DISTRICT’S BOARD OF SUPERVISORS PURSUANT TO SECTION 190.012(2), FLORIDA STATUTES; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

The proposed Woodland Preserve Community Development District includes approximately 250.099 acres generally located between Spencer Parrish Road to the west, Jim Davis Road to the east, Manatee County, Florida see map below. The Woodland Preserve Development may include 746 single family residential units.

All interested parties may appear and be heard at the meeting with respect to the proposed Ordinances. According to Florida Statutes, Section 286.0105, any person desiring to appeal any decision made by the Board of County Commissioners with respect to any matter considered at said Public Hearing will need a record of the proceedings, and for such purposes, he may need to ensure that a verbatim record of the proceedings is made, which includes the testimony and evidence upon which the appeal is to be based.

Rules of procedure for Public Comment and Citizens’ Comments (including time limits) are governed by Resolution R-25-013, Restated Rules of Procedure (adopted 1/28/25).
