NOTICE OF LOCAL DEVELOPMENT AGREEMENT CHANGES IN UNINCORPORATED MANATEE COUNTY

NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Manatee County will conduct a Public Hearing on August 13, 2024, at 9:00 a.m., and August 27, 2024, at 9:00 a.m., or as soon thereafter as same may be heard at the Manatee County Government Administration Building, 1st Floor Patricia M. Glass Chambers, 1112 Manatee Avenue West, Bradenton, Florida, to consider and act upon the following matters:

LDA-23-02 - LOCAL DEVELOPMENT AGREEMENT / SM RANCH - PLN2306-0507

Request for approval of a Local Development Agreement relating to future projects within an area identified as SM Ranch to establish the terms under which the Applicant shall commit to design, engineer, permit and construct, Transportation System Improvements to the public facilities in the vicinity of the Project Site, the developer shall dedicate or convey certain lands for the right-of-way for the Transportation System Improvements intended to serve the needs of, and address the traffic impacts created by, the Development sufficient to accomplish one or more mobility improvements that will benefit a regionally significant transportation facility, the County shall provide an extension of concurrency approval, and the County shall provide partial reimbursement and multi-modal impact fee credits.

GAMBLE CREEK ASSOCIATES, LCC and KH WOODLAND PRESERVE, Developer of the 252.4+/-acre parcel, has an approved Planned Development Residential project. It was approved as PDR-20- 16(Z)(G), northeast corner of Golf Course Road and Spencer Parrish Road, at 5300 Spencer Parrish Road, Parrish, (Manatee County). The approved development includes 746 residential units. The maximum permitted height of any residential building within the Project Site is thirty-five (35) feet.

LDA-24-01 - LOCAL DEVELOPMENT AGREEMENT / NEWPORT ISLES - PLN2401-0109

Request for approval of a Local Development Agreement relating to future projects within an area identified as Newport Isles to establish the terms under which the Applicant shall commit to design, engineer, permit and construct, its proportionate share mitigation of required improvements to the public facilities in the vicinity of the Project Site, the developer shall dedicate or convey certain lands for the right-of-way for the Mitigation Improvements intended to serve the needs of, and address the traffic impacts created by, the Development sufficient to accomplish one or more mobility improvements that will benefit a regionally significant transportation facility, the County shall provide an extension of concurrency approval, and the County shall provide multi-modal impact fee credits.

 CC MANATEE LAND INVESTMENTS, LLC, Landowner of the 1,558-acre parcel, has an approved Large Project Application - Planned Development Mixed Use project. It was approved as PDMU-06-21(P)(R4), generally located at the northwest corner of Buckeye Road and I-75, at 14000 Grass Farm Road, Palmetto, (Manatee County). The approved development includes 3,382 residential units and up to a 20-acre future/potential school site. The maximum permitted heights of any residential building within the Project Site is thirty-five (35) feet.

REGARDING THE PROPOSED ISSUANCE OF
HILLSBOROUGH COUNTY INDUSTRIAL DEVELOPMENT AUTHORITY,
Health System Revenue Bonds,
BayCare Health System Issue (MULTIPLE SERIES)
TO FINANCE CAPITAL PROJECTS IN MANATEE COUNTY

A public hearing will be conducted by the Board of County Commissioners of Manatee County, Florida (the “County”) on Tuesday, August 13, 2024 on or about 9:00 a.m. in the Commission Chambers on the First Floor of the Manatee County Government Administrative Center at 1112 Manatee Avenue West, Bradenton, Florida 34205.

The hearing is open to the public and is being held pursuant to the provisions of Section 147(f) of the Internal Revenue Code of 1986, as amended (the “Code”), with regard to the proposed issuance by the Hillsborough County Industrial Development Authority (the “Authority”) of an amount not to exceed $1,900,000,000 Hillsborough County Industrial Development Authority, Health System Revenue Bonds, BayCare Health System Issue (Multiple Series) (the “Bonds”). The Bonds will be issued as “qualified 501(c)(3) bonds” as defined in Section 145 of the Code for the purpose of financing and refinancing hospital and healthcare facilities, furnishings and equipment for BayCare Health System, Inc. (“BayCare”) and its affiliates, as described herein.  The Bonds will be issued in one or more series during a 3-year period pursuant to a 3-year plan of finance.  The first series of Bonds are expected to be issued not later than 1 year from the date of approval by the County of the plan of finance described herein.

BayCare will use a portion of the proceeds of the Bonds to finance, refinance and reimburse the costs of the projects described below to be located in Manatee County, Florida, and to pay capitalized interest on the Bonds and costs of issuance of the Bonds, as follows:

The public hearing is being held for the purpose of affording residents of Manatee County, Florida, and other interested persons an opportunity to express their views, both orally and in writing, on the proposed issuance of the Bonds and the nature and location of the projects to be financed and refinanced with the proceeds thereof.

THE BONDS WILL BE SPECIAL, LIMITED OBLIGATIONS OF THE AUTHORITY, PAYABLE SOLELY FROM PAYMENTS TO BE MADE BY BAYCARE AND ITS AFFILIATES.  THE BONDS WILL NOT CONSTITUTE AN INDEBTEDNESS OF THE STATE OF FLORIDA, MANATEE COUNTY, HILLSBOROUGH COUNTY, OR THE AUTHORITY.

The public hearing is required by Section 147(f) of the Code. Subsequent to the public hearing, the Board of County Commissioners of the County will consider whether to approve the issuance of the Bonds as required by Section 147(f) of the Code. Any person interested in the proposed issuance of the Bonds or the location or nature of the projects described herein may appear and be heard at the public hearing.

All interested parties may appear and be heard at the meeting with respect to the proposed Ordinances. According to Florida Statutes, Section 286.0105, any person desiring to appeal any decision made by the Board of County Commissioners with respect to any matter considered at said Public Hearing will need a record of the proceedings, and for such purposes, he may need to ensure that a verbatim record of the proceedings is made, which includes the testimony and evidence upon which the appeal is to be based.

Rules of procedure for Public Comment and Citizens’ Comments (including time limits) are governed by Resolution R-25-013, Restated Rules of Procedure (adopted 1/28/25).
