Forgiveness of Debt of Returned Items

Action Requested
Authorization for the Property Management Department to forgive the indebtedness resulting from two (2) returned checks for insufficient funds in the amount of $1,491.46.  Both of these items were presented for payment in July 2012.

Enabling/Regulating Authority
Florida State Statute 17.041 requires Board of County Commissioners approval for forgiveness of debt.

Background Discussion
  • The Property Management Department oversees the collection of royalties from those vendors providing food and snack services at the Judicial Center.
  • Having a food vendor in the Judicial Center fulfills a need for Court Administration to have food service in the immediate vicinity for the juror pool.
  • The current food vendor (You've Been Served Cafe) entered into an agreement with the County to provide food service and pay a 10% royalty.  This vendor realized that the foot traffic into the Judicial Center could not support a food operation at a 10% royalty and requested that the agreement be amended.  The County's Purchasing Department orchestrated an amendment to this agreement calling for a 1% royalty.  
  • Since entering into this new royalty structure, the vendor has made all monthly payments in a timely manner.
